To hire these vans, you must meet the following requirements:
o The tow vehicle must meet the following tow capacity – Jayco Lark camper 1500kgs – Jayco Outback Journey 2500kgs – Jayco Outback Starcraft 2800kgs
o An electric brake controller must be fitted to the tow vehicle. Alternatively, these are available for hire from Jayco Bundaberg for $100.00
o To secure the van hire period all paper work must be completed and a deposit paid. 
o A $500.00 bond must be paid on the day the hire van is collected, this can be paid by either cash or card and will be refunded once the hire van is returned and has been inspected

Standard Terms & Conditions
1. AGREEMENT
1.1 All caravans provided for hire by Jayco Bundaberg are provided and hired under this Agreement, except as otherwise agreed in writing.
1.2 Any person, by using the Jayco Bundaberg website, making a Hire Application, otherwise attempting to procure the hire of a caravan from Jayco Bundaberg, or hiring a caravan from Jayco Bundaberg, agrees to be bound by this Agreement.
2. INTERPRETATION
2.1 In this Agreement:
(a) ‘Agreement’ means these Standard Terms and Conditions and any Booking Confirmation or Hire Schedule for a particular caravan hire;
(b) ‘Booking Confirmation’ means written confirmation from Jayco Bundaberg of the details of a Hire Application made by the Customer;
(c) ‘Caravan’ means the caravan, and any nominated inclusions or additional items, as specified in the Booking Confirmation or Hire Schedule or, as the case may be, substituted by Jayco Bundaberg under this Agreement;
(d) ‘Customer’ means any person who makes a Hire Application, and any person nominated under the headings ‘Customer Details’, and, with respect to the use or operation of a Caravan, any person nominated under the heading ‘Drivers’ Details’, in the Booking Confirmation or Hire Schedule.
(e) ‘Deposit’ means the amount specified in the Booking Confirmation as the deposit payable for a particular booking;
(f) ‘Hire Application’ means an application or request communicated to Jayco Bundaberg to hire a caravan from Jayco Bundaberg;
(g) ‘Hire Bond’ means the bond amount specified in the Booking Confirmation;
(h) ‘Hire Charges’ means the costs for the hire of the Caravan, including the cost of any Inclusions and Premium Insurance purchased, as specified in the Booking Confirmation or Hire Schedule, or otherwise communicated by Jayco Bundaberg;
(i) ‘Hire Period’ means the period for the hire by the Customer of the Caravan specified in the Booking Confirmation or Hire Schedule or as amended under this Agreement;
(j) ‘Inclusions’ means the inclusions nominated in the Booking Confirmation or Hire Schedule;
(k) ‘Return Date’ and ‘Return Time’ mean, respectively, the date and time for the return of the Caravan to Jayco Bundaberg by the Customer specified in the Booking Confirmation or Hire Schedule or as amended under this Agreement;
(l) ‘Hire Schedule’ means the document titled ‘Hire Schedule’ completed at the time the Customer collects a Caravan under this Agreement.
(m) ‘Pickup Date’ and ‘Pickup Time’ mean, respectively, the date and time for the pickup of a Caravan by the Customer as specified in the Booking Confirmation.
(n) ‘Towing Vehicle’ means the vehicle so specified in the Booking Confirmation or Hire Schedule; and
(o) ‘Jayco Bundaberg’ means Jayco Bundaberg Pty Ltd ACN 612 827 568.
2.2 Any Word or phrase not defined in clause 2.1 but given a meaning in a Booking Confirmation or Hire Schedule has, in these Terms and Conditions, the meaning so given.
2.3 Where a party comprises 2 or more persons, an agreement or obligation to be performed or observed by that party binds those persons jointly and severally and a reference to that party includes a reference to any one or more of those persons;
2.4 This Agreement is governed by the laws of Queensland and the Commonwealth of Australia.
2.5 All prices expressed are in Australian dollars. The Customer is liable for any loss or shortfall due to fluctuation in exchange rates. The Customer is liable for any additional costs associated with international payments.
2.6 In the interpretation of this Agreement, headings are to be disregarded.
3. DEPOSIT
3.1 The Customer must pay the Deposit to Jayco Bundaberg within three days of receiving the Booking Confirmation or as otherwise provided by the Booking Confirmation.
3.2 No booking of a caravan hire is secure until the Customer pays the Deposit by the time provided for in clause 3.1 or the Booking Confirmation.
4. PAYMENT
4.1 Prices advertised by Jayco Bundaberg are indicative and subject to change without notice. However, subject to this Agreement, prices and Hire Charges specified in the Booking Confirmation are secured following payment by the Customer of the Deposit. 4.2 The Customer must pay to Jayco Bundaberg all Hire Charges no later than 28 days prior to the Pickup Date, or by another date as agreed to in writing by Jayco Bundaberg. Nothing in this clause prevents Jayco Bundaberg from accepting a booking within 28 days prior to the Pickup Date or at any other time. 4.3 If the Customer does not pay to Jayco Bundaberg all Hire Charges by the time provided for in clause 4.1 Jayco Bundaberg may cancel the Customer’s booking without further notice and may retain the full Deposit.
4.4 The Customer is not entitled to collect the Caravan until the Customer has paid, by cleared funds, all Hire Charges, including the Hire Bond.
5. CANCELLATION 5.1 Subject to this Agreement, the Customer may cancel a booking of a caravan hire only by written notice to Jayco Bundaberg at least 14 clear calendar days prior to the Pickup Time. The Customer forfeits the Deposit at the time of cancelling. Any cancellation notified to Jayco Bundaberg after this time will result in the forfeiture of the Deposit and the Hire Charges.
5.2 The Customer is deemed to have cancelled a booking if, and at the time that:
(a) The Customer fails to pay the Hire Bond on or before the Pickup Time;
(b) The Towing Vehicle is not, to the reasonable satisfaction of Jayco Bundaberg, fit and appropriate to tow the Caravan up to the maximum loaded weight specified for the Caravan;
(c) The Customer fails to provide evidence of a valid driver licence for each of the Customer and each Driver listed in the Booking Confirmation or Hire Schedule, each driver licence being of such class or kind as allows for the lawful towing of the Caravan. Such a driver licence must be written in English, or be accompanied by a certified translation, or be a valid international driver permit;
(d) The Customer fails to provide evidence of registration of the Towing Vehicle that will be valid for the whole of the Hire Period, if requested by Jayco Bundaberg; or
(e) On or before the Pickup Date, it become reasonably apparent to Jayco Bundaberg that the Customer has breached any warranty given by the Customer either under this Agreement or
otherwise, or that it is not reasonably likely the Customer will be able to comply with any part of this Agreement.
5.3 The Customer is not entitled to any refund of Hire Charges or the Deposit with respect to cancellation by the Customer due to inclement weather or changes in road conditions.
5.4 Jayco Bundaberg may for any reason other than those set out above in 5.2 above cancel a booking of a caravan hire at any time by notice to the Customer, in which case the liability of Jayco Bundaberg is limited absolutely to the refund of any Deposit or Hire Charges already paid by the Customer.
6. HIRE BOND
6.1 At or before the Pickup Time, the Customer must pay to Jayco Bundaberg the Hire Bond by providing a credit card or debit card acceptable to Jayco Bundaberg with sufficient funds available or clear funds for the Hire Bond plus any unpaid Hire Charges. The Customer agrees to Jayco Bundaberg withdrawing from any relevant account funds equivalent to the Hire Bond and any unpaid Hire Charges. The Customer acknowledges the funds or equivalent amount credit representing the Hire Bond will not be available to The Customer until the Hire Bond is returned pursuant to this Agreement.
6.2 The Customer irrevocably authorises Jayco Bundaberg to complete any documentation and to take any other action to recover from the Hire Bond or from the Customer’s credit card issuer all amounts, notwithstanding the payment or amount of the Hire Bond, for which the Customer is or becomes liable to Jayco Bundaberg under this Agreement or otherwise, including, but not limited to, any outstanding Hire Charges, any amounts due in respect of damage to the Caravan or to property of a third party, losses due to the Customer’s breach of this Agreement, and all other additional charges as incurred (including all parking and traffic infringement penalties, road toll fines and associated administration costs).
6.3 For the avoidance of doubt, any liability of the Customer to Jayco Bundaberg is not limited by the Hire Bond or payment thereof.
6.4 Recovery by Jayco Bundaberg from the Hire Bond of any amount for which the Customer is without prejudice to any other rights Jayco Bundaberg may have against the Customer. Jayco Bundaberg retains the right to recover amounts for which the Customer is liable in excess of the Bond Amount.
6.5 Subject to the rights of Jayco Bundaberg under this Agreement to retain amounts from the Hire Bond owing to it, following the Return of the Caravan to Jayco Bundaberg, Jayco Bundaberg will refund or return the Hire Bond, or the relevant part of the Hire Bond, to the Customer within 5 business days after the completion of condition or inventory checks on the Caravan. Jayco Bundaberg will conduct any such checks within a reasonable time. The refund or return by Jayco Bundaberg of any part of the Hire Bond is without prejudice to any other rights of Jayco Bundaberg.
7. PREMIUM INSURANCE
7.1 Without derogation to clause 8.1(a) or any other obligation on the Customer set out within this Agreement, the Customer may (but at the discretion of Jayco Bundaberg) purchase from Jayco Bundaberg Premium Insurance in respect of the Customer’s hire of the Caravan.
7.2 The price for Premium Insurance available for purchase by the Customer for a given hire is set out in the Hire Schedule. If the customer purchases Premium Insurance, the Customer must pay the price thereof for the full Hire Period prior to collecting the Caravan.
7.3 In addition to this Agreement, the terms of any Premium Insurance purchased include those provided separately to the Customer. The Customer acknowledges that the Customer has been provided with and read the relevant Premium Insurance policy.
8. TOWING VEHICLE
8.1 The Customer warrants to Jayco Bundaberg that:
(a) The towing vehicle is covered by comprehensive insurance, including for third-party liability; and
(b) The towing vehicle is fit and appropriate to tow the Caravan up to the maximum loaded weight specified for the Caravan.
8.2 The Customer must comply with any reasonable request of Jayco Bundaberg to assist the verification of the Towing Vehicle, including but not limited to the provision of evidence of the insurance covering the Towing Vehicle;
8.3 The Towing Vehicle must, on the Pickup Date, within the Hire Period, and at any time at which the Customer operates the Caravan, be fitted with (at the Customer’s expense) an appropriate electronic braking system for the proper operation of the Caravan’s brake lights by application of the Towing Vehicle’s brakes. Jayco Bundaberg will provide the corresponding system for the Caravan.
8.4 The Customer must only tow the Caravan using the towing vehicle specified in the hire schedule.
8.5 The Customer must collect the Caravan using the towing vehicle specified in the hire schedule or the booking confirmation.
8.6 Jayco Bundaberg may, prior to providing the Caravan to the Customer, view the towing vehicle, and the Customer must take all reasonable steps to comply with all reasonable requests to facilitate such viewing. If the towing vehicle is not, to the reasonable satisfaction of Jayco Bundaberg, fit or appropriate to tow the Caravan, Jayco Bundaberg may refuse to provide the Caravan to the Customer, in which event the Customer forfeits the whole of the Deposit.
8.7 The Customer must not tow the Caravan, or allow the Caravan to be towed by, any vehicle other than the Towing Vehicle, other than with the prior written consent of Jayco Bundaberg or than is reasonably necessary in relation to an accident involving the Caravan.
9. HIRE OF CARAVAN
9.1 The Customer is not entitled to collect the Caravan until it has paid all Hire Charges and the Hire Bond.
9.2 On the Pickup Date, Jayco Bundaberg may require the Customer to complete a condition report for the Caravan, which is deemed to form part of the Hire Schedule. If the Customer does not complete such condition report, the Customer is deemed to accept all comments of Jayco Bundaberg therein.
9.3 Upon:
(a) Payment by the Customer of any Deposit, Rental Charges, and Hire Bond;
(b) Completion of the Hire Schedule by the parties;
(c) An inspection of the Towing Vehicle to the satisfaction of Jayco Bundaberg having regard to clause 8; and
(d) The provision by the Customer to Jayco Bundaberg of any information, material, or evidence as required by this Agreement prior to the Pickup Time or Pickup Date;
Jayco Bundaberg grants a limited personal licence to the Customer to use the Caravan for the Hire Period subject to the terms of this Agreement.
9.4 The Customer is responsible for collecting the Caravan for hire by attending the premises of Jayco Bundaberg at 10 Kendalls Rd, Avoca, Queensland, and there doing all things required by this Agreement precedent to the hire of the Caravan.
9.5 The Customer must provide its own bedsheets and linen. The Customer must not use any bedding installed in the Caravan without a bedsheet covering the surface of the bed. The Customer must keep all of its own bedding and installed bedding in the Caravan clean.
9.6 Jayco Bundaberg may at any time substitute the Caravan described in the Booking Confirmation or Hire Schedule with a Caravan that is a reasonably suitable replacement, having regard to reasonable factors including the number of persons specified in the Booking Confirmation.
9.7 The Customer acknowledges that Jayco Bundaberg retains title to the Caravan at all times. The Customer must not agree, attempt, offer, or purport to sell, assign, transfer, sub-let, lend, pledge, mortgage, or otherwise part with the Customer’s personal possession of the Caravan.
10. USE OF CARAVAN
10.1 In relation to the use, operation, occupation, or towing of the Caravan, the Customer must:
(a) comply with any instructions, warnings, or guidelines reasonably given by Jayco Bundaberg to the Customer, in any manual provided to the Customer for the Caravan, or written on or in the Caravan;
(b) inspect the caravan daily to ensure all brake and blinker lights are functioning and all tyres are properly inflated; (c) Comply with all road rules, signs, and traffic direction;
(d) Exercise reasonable care and caution;
(e) Not tow the Caravan when the driver at the relevant time is to any degree under the influence of alcohol or drugs;
(f) If any connectors, plugs, adaptors, or other such equipment for the connecting of the Caravan to the Towing Vehicle are supplied with the Caravan, only use that equipment
(g) Only attempt routes and distances within the Customer’s capability, and take regular breaks from driving or towing;
(h) Comply with any instructions specified in the hire schedule;
(i) Not tow the Caravan where either of the Caravan or the towing vehicle is in an unroadworthy condition;
(j) Not alter, modify, or tamper with the Caravan or any fixtures or lectures thereof;
(k) Ensure the Caravan is properly secured to the towing vehicle while towing or attempting to tow the Caravan;
(l) Not load the Caravan to above the maximum load as specified in any manual provided for the Caravan or in the high schedule;
(m) Not keep any large or heavy items (including but not limited to fridges or coolers) on the floor of the Caravan in any way that may be scratches or marks;
(n) Not leave any awnings or other external annexures or fixtures of the Caravan up or extended in windy conditions all while unattended;
(o) ensure the security of the Caravan, and of the towing vehicle when the Caravan is attached to the towing vehicle, lock the Caravan or towing vehicle while either is unattended, and not leave key in or near the Caravan and towing vehicle while unattended;
(p) Monitor and conduct regular checks of tyre pressure, oil, water, and braking systems of the Cavan and Towing Vehicle;
(q) Not leave the Caravan under attended for more than eight hours or for longer than is reasonable;
(r) To the Caravan in a safe manner having regard to road and weather conditions;
(s) Always tow the Caravan at speeds within the limits of the law and with consideration to safe driving limits and at no time tow the Caravan at speeds exceeding 100 km/h;
(t) Adhere to any route specified in the Booking Confirmation, except with the prior agreement of Warburton Caravans;
(u) Not allow the Caravan to come into contact with salt water; (v) Not tow the Caravan on any unsealed road or other transportation route;
(w) Not tow the Caravan through, or leave the Caravan in, areas that are swollen watercourses or at risk of flooding, beach, below any high water mark, or above any snowline;
(x) Not allow the Caravan to be submerged to any degree in water;
(y) not allow the Caravan to carry or berth more persons than permitted by any relevant authority or set out in the Caravan’s manual or on the Caravan or in the hire schedule;
(z) Not allow the Caravan to carry any persons or animals while the Caravan is being towed;
(aa) Not allow smoking in or near the Caravan;
(bb) Not allow any fire or fire smoke in the Caravan;
(cc) Not climb or sit on top of the Caravan;
(dd) Only use breaking mechanisms approved by the vehicle manufacturer or an after-market supplier;
(ee) Comply with all laws relating to the secure and proper towing of Caravans, and ensure indicator and brake lights are working;
(ff) Pay all fines infringements toll incurred while towing or using the Caravan;
(gg) Not carry, tie, or otherwise affix any item on or to the outside of the Caravan;
(hh) Comply with any reasonable instructions of Jayco Bundaberg regarding use of the Caravan;
(ii) Not use the Caravan for or in furtherance of any illegal purpose, or, regardless of lawfulness, in any race, rally, or contest;
(jj) Not use the Caravan to carry passengers or property for hire or reward;
(kk) Must not use the Caravan for purpose of haulage of items, other than as may reasonably required or expected of a hire for leisure;
(ll) Not use abrasive cleaners drops or sponges on any of the finishes of the Caravan;
(mm) Not carry any volatile liquids and gases explosive or other corrosive dangerous combustible all in flammable material in the Caravan or the towing vehicle other than as reasonably required for their operation;
10.2 The Customer must ensure that any other occupier or operator of the Caravan or Towing Vehicle complies with this clause and with the rest of this agreement as it relates to the use, occupation, or operation of the Caravan or Towing Vehicle. 10.3 The Customer consents to Jayco Bundaberg keeping and using tracking equipment on the Caravan and monitoring the location of the Caravan at any time. The Customer must not disengage or otherwise interfere with any such tracking system. The Customer consents to the use and disclosure by Jayco Bundaberg of any data so collected for operational or promotional purposes.
10.4 The Customer’s obligations under this Agreement apply notwithstanding the Hire Period specified, including but not limited to the Customer’s obligations with respect to the use of the Caravan which apply to use of the Caravan before or after the Hire Period in addition to during the Hire Period.
11. DAMAGE, BREAKDOWN, AND REPAIRS
11.1 The Customer must report any damage to the Caravan to Jayco Bundaberg as soon as possible after the damage becomes apparent.
11.2 Except as is reasonably necessary, the Customer must not tow the Caravan following damage to the Caravan, other than merely superficial damage, becomes apparent, or use any damaged part of the Caravan, without the prior approval or consent of Jayco Bundaberg.

11.4 The Customer bears the cost, absolutely, for any repair or replacement of the Caravans tyres or rims during the Hire Period, unless:
(a) The Customer can prove beyond a reasonable doubt that the tyre or rim repaired or replaced was defective at the time the Caravan was collected from Jayco Bundaberg; and
(b) The Customer returns the tyre or rim to Jayco Bundaberg for inspection; and
(c) A warranty claim with respect to the tyre is successful.
11.5 The Customer must follow all reasonable directions given by Jayco Bundaberg with respect to any damage of the Caravan, the subsequent use of the Caravan, or the effecting of repairs.
11.6 The Customer must not allow repairs to be carried out with respect to the Caravan or otherwise cause costs to be incurred on behalf of Jayco Bundaberg without first obtaining the written consent of Jayco Bundaberg.
11.7 If the Customer causes the Caravan to be repaired or inspected for the purpose of making repairs or assessing damage, the Customer consents to, and must on Jayco Bundaberg request do everything reasonably possible to facilitate, the reporting of the results of such repair or inspection to Jayco Bundaberg.
11.8 In the event of any motor vehicle accident involving the Caravan, the Customer must:
(a) Notify Jayco Bundaberg immediately, or otherwise as soon as is reasonably possible;
(b) Take all reasonable steps to obtain the names and addresses of any parties or witnesses to the event;
(c) Report the event to police;
(d) Not accept or admit blame or assert the fault of another party;
(e) Record, and if possible photograph, all damage to the Caravan and other vehicles and registration numbers;
(f) Provide to Jayco Bundaberg any photographs, police reports, or other records relating to the event; and
(g) Provide all reasonable assistance to Jayco Bundaberg in relation to any claim, including providing any relevant information or attending court.
11.9 Jayco Bundaberg may, at its absolute discretion, provide the Customer with an appropriate substitute Caravan, in which event the Customer will not be liable for any increased hire charges. Such a substitution does not entitle the Customer to a refund and does not constitute a breach of this Agreement.
11.10 The Customer is liable to Jayco Bundaberg for any costs associated with the retrieval of the Caravan in the event of damage or failure, except where the cause of the failure is proven beyond a reasonable doubt to be wholly due to a mechanical failure of the Caravan (not caused, or in any way contributed to, by the hire to the Customer) or to the fault of Jayco Bundaberg.
11.11 If the Caravan suffers damage or breakdown due to the mechanical failure of the Caravan, the liability of Jayco Bundaberg is limited strictly to a refund of the Hire Charges on a pro rata basis for the remaining part of the Hire Period.
12. RETURN OF CARAVAN
12.1 The Customer must return the cleaned Caravan to Jayco Bundaberg by the Return Time and:
(a) At the place from which the Customer collected the Caravan; or
(b) At such other place that is reasonably nominated by Jayco Bundaberg and communicated to the Customer with reasonable notice.
12.2 The Customer request Jayco Bundaberg to agree to a different Return Time than that originally specified, however this remains in the absolute discretion of Jayco Bundaberg.
12.3 If the Customer returns the Caravan after 5:00pm on a given day, the Customer is deemed to have returned the Caravan first on the next day.
12.4 If the Customer does not return the Caravan in accordance with clause 12.1, the Customer is liable to Jayco Bundaberg for, in addition to any amount otherwise owing under this Agreement: (a) For each day or part thereof after the Return Time in which the Customer has not returned the Caravan in accordance with clause 12.1, a daily hire charge equal to 110% of the pro rata daily Hire Charge as specified for the Hire Period;
(b) An administration fee of $75;
(c) A cleaning fee of $250 or more depending on the cost to clean the Caravan;
(d) Any losses or costs of Jayco Bundaberg relating to its inability to hire the Caravan to any other person;
(e) Any cost of retrieving or attempting to retrieve the Caravan from a location other than that provided for by clause 12.1; and
(f) Any other losses arising from or in relation to the Customer’s failure to return the Caravan in accordance with clause 12.1.
12.5 The Customer must return the Caravan in the same condition as the Caravan was in on the Pickup Date, including as noted in any condition report. The Customer is strictly liable for any damage, state or uncleanliness, or other difference from the condition the Caravan was in on the Pickup Date. 12.6 Without limiting the Customer’s liability under this agreement, if when or after the Customer returns the Caravan it is apparent, to the reasonable satisfaction of Jayco Bundaberg, that the
Caravan or part of the Caravan is not clean, the Customer will be liable to Jayco Bundaberg for a cleaning and administration fee of $250 internal and $250 external. 12.7 Immediately, or otherwise as soon as possible before returning the Caravan to Jayco Bundaberg, the Customer must empty any toiletry systems and ensure any toilet within the Caravan is clean. If the Customer returns the Caravan and has not complied with this clause, or if any toiletry system or toilet is not clean, the Customer will be liable to Jayco Bundaberg for a fee of $500.00 for the replacement of the toilet cartridge and disposal of the used cartridge. The Customer’s liability under this clause is in addition to any other liability with respect to cleaning.
13. TERMINATION AND REPOSSESSION
13.1 Jayco Bundaberg may terminate this Agreement at any time if Jayco Bundaberg is reasonably satisfied that:
(a) The Customer has breached or is likely to breach any part of this Agreement;
(b) The Customer has engaged in fraud or misrepresentation in relation to the hire of the Caravan;
(c) The Caravan appears to have been abandoned;
(d) The Caravan has not been, or is not likely to be, returned by the Return Time;
(e) The safety of any passengers of the Caravan, including the Customer, or the condition of the Caravan is endangered; or
(f) The Customer has, in connection with the Caravan or at all during the Hire Period, broken any law.
13.2 Jayco Bundaberg may terminate this Agreement under clause 13.1 by email or telephone, including by leaving a voice message, to any email address or telephone number, respectively, of the Customer as specified in the Booking Confirmation or Hire Schedule or otherwise advised by the Customer.
13.3 If Jayco Bundaberg terminates this Agreement under or in relation to any of the matters set out in clause 13.1:
(a) The Customer is not entitled to any refund;
(b) Jayco Bundaberg or its agents may, to which the Customer is deemed to consent, enter upon any premises to retrieve the Caravan;
(c) The Customer is liable for any costs associated with the retrieval, towing, and cleaning of the Caravan.
14. INDEMNITY
14.1 The Customer indemnifies and shall keep indemnified Jayco Bundaberg from and against all claims, loss, damages and expenses whatsoever, incurred directly or indirectly by reason of any breach of this Agreement, negligence, malicious or tortious act or other wrong doing by the Customer or a person occupying using or operating the Caravan. Without limiting the foregoing or any of the Customer’s obligations under this agreement, the Customer specifically indemnifies Jayco Bundaberg for:
(a) all damage to or loss of the Caravan howsoever arising to the extent to which the same is not recoverable under any policy or insurance or on account of any act or omission or breach of this agreement by the Customer or any act or omission of a person operating using or occupying the Caravan except to the extent caused or contributed by Jayco Bundaberg.
(b) injury to or death of any person and damage to any property and all claims, damages, losses and expenses howsoever arising from or incidental to the possession, use, operation or towing of the Caravan trailer except to the extent caused or contributed by the owner;
(c) The cost of rectifying all tyre or wheel damage not attributable to faStandard Terms & Conditions
1. AGREEMENT
1.1 All caravans provided for hire by Jayco Bundaberg are provided and hired under this Agreement, except as otherwise agreed in writing.
1.2 Any person, by using the Jayco Bundaberg website, making a Hire Application, otherwise attempting to procure the hire of a caravan from Jayco Bundaberg, or hiring a caravan from Jayco Bundaberg, agrees to be bound by this Agreement.
2. INTERPRETATION
2.1 In this Agreement:
(a) ‘Agreement’ means these Standard Terms and Conditions and any Booking Confirmation or Hire Schedule for a particular caravan hire;
(b) ‘Booking Confirmation’ means written confirmation from Jayco Bundaberg of the details of a Hire Application made by the Customer;
(c) ‘Caravan’ means the caravan, and any nominated inclusions or additional items, as specified in the Booking Confirmation or Hire Schedule or, as the case may be, substituted by Jayco Bundaberg under this Agreement;
(d) ‘Customer’ means any person who makes a Hire Application, and any person nominated under the headings ‘Customer Details’, and, with respect to the use or operation of a Caravan, any person nominated under the heading ‘Drivers’ Details’, in the Booking Confirmation or Hire Schedule.
(e) ‘Deposit’ means the amount specified in the Booking Confirmation as the deposit payable for a particular booking;
(f) ‘Hire Application’ means an application or request communicated to Jayco Bundaberg to hire a caravan from Jayco Bundaberg;
(g) ‘Hire Bond’ means the bond amount specified in the Booking Confirmation;
(h) ‘Hire Charges’ means the costs for the hire of the Caravan, including the cost of any Inclusions and Premium Insurance purchased, as specified in the Booking Confirmation or Hire Schedule, or otherwise communicated by Jayco Bundaberg;
(i) ‘Hire Period’ means the period for the hire by the Customer of the Caravan specified in the Booking Confirmation or Hire Schedule or as amended under this Agreement;
(j) ‘Inclusions’ means the inclusions nominated in the Booking Confirmation or Hire Schedule;
(k) ‘Return Date’ and ‘Return Time’ mean, respectively, the date and time for the return of the Caravan to Jayco Bundaberg by the Customer specified in the Booking Confirmation or Hire Schedule or as amended under this Agreement;
(l) ‘Hire Schedule’ means the document titled ‘Hire Schedule’ completed at the time the Customer collects a Caravan under this Agreement.
(m) ‘Pickup Date’ and ‘Pickup Time’ mean, respectively, the date and time for the pickup of a Caravan by the Customer as specified in the Booking Confirmation.
(n) ‘Towing Vehicle’ means the vehicle so specified in the Booking Confirmation or Hire Schedule; and
(o) ‘Jayco Bundaberg’ means Jayco Bundaberg Pty Ltd ACN 612 827 568.
2.2 Any Word or phrase not defined in clause 2.1 but given a meaning in a Booking Confirmation or Hire Schedule has, in these Terms and Conditions, the meaning so given.
2.3 Where a party comprises 2 or more persons, an agreement or obligation to be performed or observed by that party binds those persons jointly and severally and a reference to that party includes a reference to any one or more of those persons;
2.4 This Agreement is governed by the laws of Queensland and the Commonwealth of Australia.
2.5 All prices expressed are in Australian dollars. The Customer is liable for any loss or shortfall due to fluctuation in exchange rates. The Customer is liable for any additional costs associated with international payments.
2.6 In the interpretation of this Agreement, headings are to be disregarded.
3. DEPOSIT
3.1 The Customer must pay the Deposit to Jayco Bundaberg within three days of receiving the Booking Confirmation or as otherwise provided by the Booking Confirmation.
3.2 No booking of a caravan hire is secure until the Customer pays the Deposit by the time provided for in clause 3.1 or the Booking Confirmation.
4. PAYMENT
4.1 Prices advertised by Jayco Bundaberg are indicative and subject to change without notice. However, subject to this Agreement, prices and Hire Charges specified in the Booking Confirmation are secured following payment by the Customer of the Deposit. 4.2 The Customer must pay to Jayco Bundaberg all Hire Charges no later than 28 days prior to the Pickup Date, or by another date as agreed to in writing by Jayco Bundaberg. Nothing in this clause prevents Jayco Bundaberg from accepting a booking within 28 days prior to the Pickup Date or at any other time. 4.3 If the Customer does not pay to Jayco Bundaberg all Hire Charges by the time provided for in clause 4.1 Jayco Bundaberg may cancel the Customer’s booking without further notice and may retain the full Deposit.
4.4 The Customer is not entitled to collect the Caravan until the Customer has paid, by cleared funds, all Hire Charges, including the Hire Bond.
5. CANCELLATION 5.1 Subject to this Agreement, the Customer may cancel a booking of a caravan hire only by written notice to Jayco Bundaberg at least 14 clear calendar days prior to the Pickup Time. The Customer forfeits the Deposit at the time of cancelling. Any cancellation notified to Jayco Bundaberg after this time will result in the forfeiture of the Deposit and the Hire Charges.
5.2 The Customer is deemed to have cancelled a booking if, and at the time that:
(a) The Customer fails to pay the Hire Bond on or before the Pickup Time;
(b) The Towing Vehicle is not, to the reasonable satisfaction of Jayco Bundaberg, fit and appropriate to tow the Caravan up to the maximum loaded weight specified for the Caravan;
(c) The Customer fails to provide evidence of a valid driver licence for each of the Customer and each Driver listed in the Booking Confirmation or Hire Schedule, each driver licence being of such class or kind as allows for the lawful towing of the Caravan. Such a driver licence must be written in English, or be accompanied by a certified translation, or be a valid international driver permit;
(d) The Customer fails to provide evidence of registration of the Towing Vehicle that will be valid for the whole of the Hire Period, if requested by Jayco Bundaberg; or
(e) On or before the Pickup Date, it become reasonably apparent to Jayco Bundaberg that the Customer has breached any warranty given by the Customer either under this Agreement or
otherwise, or that it is not reasonably likely the Customer will be able to comply with any part of this Agreement.
5.3 The Customer is not entitled to any refund of Hire Charges or the Deposit with respect to cancellation by the Customer due to inclement weather or changes in road conditions.
5.4 Jayco Bundaberg may for any reason other than those set out above in 5.2 above cancel a booking of a caravan hire at any time by notice to the Customer, in which case the liability of Jayco Bundaberg is limited absolutely to the refund of any Deposit or Hire Charges already paid by the Customer.
6. HIRE BOND
6.1 At or before the Pickup Time, the Customer must pay to Jayco Bundaberg the Hire Bond by providing a credit card or debit card acceptable to Jayco Bundaberg with sufficient funds available or clear funds for the Hire Bond plus any unpaid Hire Charges. The Customer agrees to Jayco Bundaberg withdrawing from any relevant account funds equivalent to the Hire Bond and any unpaid Hire Charges. The Customer acknowledges the funds or equivalent amount credit representing the Hire Bond will not be available to The Customer until the Hire Bond is returned pursuant to this Agreement.
6.2 The Customer irrevocably authorises Jayco Bundaberg to complete any documentation and to take any other action to recover from the Hire Bond or from the Customer’s credit card issuer all amounts, notwithstanding the payment or amount of the Hire Bond, for which the Customer is or becomes liable to Jayco Bundaberg under this Agreement or otherwise, including, but not limited to, any outstanding Hire Charges, any amounts due in respect of damage to the Caravan or to property of a third party, losses due to the Customer’s breach of this Agreement, and all other additional charges as incurred (including all parking and traffic infringement penalties, road toll fines and associated administration costs).
6.3 For the avoidance of doubt, any liability of the Customer to Jayco Bundaberg is not limited by the Hire Bond or payment thereof.
6.4 Recovery by Jayco Bundaberg from the Hire Bond of any amount for which the Customer is without prejudice to any other rights Jayco Bundaberg may have against the Customer. Jayco Bundaberg retains the right to recover amounts for which the Customer is liable in excess of the Bond Amount.
6.5 Subject to the rights of Jayco Bundaberg under this Agreement to retain amounts from the Hire Bond owing to it, following the Return of the Caravan to Jayco Bundaberg, Jayco Bundaberg will refund or return the Hire Bond, or the relevant part of the Hire Bond, to the Customer within 5 business days after the completion of condition or inventory checks on the Caravan. Jayco Bundaberg will conduct any such checks within a reasonable time. The refund or return by Jayco Bundaberg of any part of the Hire Bond is without prejudice to any other rights of Jayco Bundaberg.
7. PREMIUM INSURANCE
7.1 Without derogation to clause 8.1(a) or any other obligation on the Customer set out within this Agreement, the Customer may (but at the discretion of Jayco Bundaberg) purchase from Jayco Bundaberg Premium Insurance in respect of the Customer’s hire of the Caravan.
7.2 The price for Premium Insurance available for purchase by the Customer for a given hire is set out in the Hire Schedule. If the customer purchases Premium Insurance, the Customer must pay the price thereof for the full Hire Period prior to collecting the Caravan.
7.3 In addition to this Agreement, the terms of any Premium Insurance purchased include those provided separately to the Customer. The Customer acknowledges that the Customer has been provided with and read the relevant Premium Insurance policy.
8. TOWING VEHICLE
8.1 The Customer warrants to Jayco Bundaberg that:
(a) The towing vehicle is covered by comprehensive insurance, including for third-party liability; and
(b) The towing vehicle is fit and appropriate to tow the Caravan up to the maximum loaded weight specified for the Caravan.
8.2 The Customer must comply with any reasonable request of Jayco Bundaberg to assist the verification of the Towing Vehicle, including but not limited to the provision of evidence of the insurance covering the Towing Vehicle;
8.3 The Towing Vehicle must, on the Pickup Date, within the Hire Period, and at any time at which the Customer operates the Caravan, be fitted with (at the Customer’s expense) an appropriate electronic braking system for the proper operation of the Caravan’s brake lights by application of the Towing Vehicle’s brakes. Jayco Bundaberg will provide the corresponding system for the Caravan.
8.4 The Customer must only tow the Caravan using the towing vehicle specified in the hire schedule.
8.5 The Customer must collect the Caravan using the towing vehicle specified in the hire schedule or the booking confirmation.
8.6 Jayco Bundaberg may, prior to providing the Caravan to the Customer, view the towing vehicle, and the Customer must take all reasonable steps to comply with all reasonable requests to facilitate such viewing. If the towing vehicle is not, to the reasonable satisfaction of Jayco Bundaberg, fit or appropriate to tow the Caravan, Jayco Bundaberg may refuse to provide the Caravan to the Customer, in which event the Customer forfeits the whole of the Deposit.
8.7 The Customer must not tow the Caravan, or allow the Caravan to be towed by, any vehicle other than the Towing Vehicle, other than with the prior written consent of Jayco Bundaberg or than is reasonably necessary in relation to an accident involving the Caravan.
9. HIRE OF CARAVAN
9.1 The Customer is not entitled to collect the Caravan until it has paid all Hire Charges and the Hire Bond.
9.2 On the Pickup Date, Jayco Bundaberg may require the Customer to complete a condition report for the Caravan, which is deemed to form part of the Hire Schedule. If the Customer does not complete such condition report, the Customer is deemed to accept all comments of Jayco Bundaberg therein.
9.3 Upon:
(a) Payment by the Customer of any Deposit, Rental Charges, and Hire Bond;
(b) Completion of the Hire Schedule by the parties;
(c) An inspection of the Towing Vehicle to the satisfaction of Jayco Bundaberg having regard to clause 8; and
(d) The provision by the Customer to Jayco Bundaberg of any information, material, or evidence as required by this Agreement prior to the Pickup Time or Pickup Date;
Jayco Bundaberg grants a limited personal licence to the Customer to use the Caravan for the Hire Period subject to the terms of this Agreement.
9.4 The Customer is responsible for collecting the Caravan for hire by attending the premises of Jayco Bundaberg at 10 Kendalls Rd, Avoca, Queensland, and there doing all things required by this Agreement precedent to the hire of the Caravan.
9.5 The Customer must provide its own bedsheets and linen. The Customer must not use any bedding installed in the Caravan without a bedsheet covering the surface of the bed. The Customer must keep all of its own bedding and installed bedding in the Caravan clean.
9.6 Jayco Bundaberg may at any time substitute the Caravan described in the Booking Confirmation or Hire Schedule with a Caravan that is a reasonably suitable replacement, having regard to reasonable factors including the number of persons specified in the Booking Confirmation.
9.7 The Customer acknowledges that Jayco Bundaberg retains title to the Caravan at all times. The Customer must not agree, attempt, offer, or purport to sell, assign, transfer, sub-let, lend, pledge, mortgage, or otherwise part with the Customer’s personal possession of the Caravan.
10. USE OF CARAVAN
10.1 In relation to the use, operation, occupation, or towing of the Caravan, the Customer must:
(a) comply with any instructions, warnings, or guidelines reasonably given by Jayco Bundaberg to the Customer, in any manual provided to the Customer for the Caravan, or written on or in the Caravan;
(b) inspect the caravan daily to ensure all brake and blinker lights are functioning and all tyres are properly inflated; (c) Comply with all road rules, signs, and traffic direction;
(d) Exercise reasonable care and caution;
(e) Not tow the Caravan when the driver at the relevant time is to any degree under the influence of alcohol or drugs;
(f) If any connectors, plugs, adaptors, or other such equipment for the connecting of the Caravan to the Towing Vehicle are supplied with the Caravan, only use that equipment
(g) Only attempt routes and distances within the Customer’s capability, and take regular breaks from driving or towing;
(h) Comply with any instructions specified in the hire schedule;
(i) Not tow the Caravan where either of the Caravan or the towing vehicle is in an unroadworthy condition;
(j) Not alter, modify, or tamper with the Caravan or any fixtures or lectures thereof;
(k) Ensure the Caravan is properly secured to the towing vehicle while towing or attempting to tow the Caravan;
(l) Not load the Caravan to above the maximum load as specified in any manual provided for the Caravan or in the high schedule;
(m) Not keep any large or heavy items (including but not limited to fridges or coolers) on the floor of the Caravan in any way that may be scratches or marks;
(n) Not leave any awnings or other external annexures or fixtures of the Caravan up or extended in windy conditions all while unattended;
(o) ensure the security of the Caravan, and of the towing vehicle when the Caravan is attached to the towing vehicle, lock the Caravan or towing vehicle while either is unattended, and not leave key in or near the Caravan and towing vehicle while unattended;
(p) Monitor and conduct regular checks of tyre pressure, oil, water, and braking systems of the Cavan and Towing Vehicle;
(q) Not leave the Caravan under attended for more than eight hours or for longer than is reasonable;
(r) To the Caravan in a safe manner having regard to road and weather conditions;
(s) Always tow the Caravan at speeds within the limits of the law and with consideration to safe driving limits and at no time tow the Caravan at speeds exceeding 100 km/h;
(t) Adhere to any route specified in the Booking Confirmation, except with the prior agreement of Warburton Caravans;
(u) Not allow the Caravan to come into contact with salt water; (v) Not tow the Caravan on any unsealed road or other transportation route;
(w) Not tow the Caravan through, or leave the Caravan in, areas that are swollen watercourses or at risk of flooding, beach, below any high water mark, or above any snowline;
(x) Not allow the Caravan to be submerged to any degree in water;
(y) not allow the Caravan to carry or berth more persons than permitted by any relevant authority or set out in the Caravan’s manual or on the Caravan or in the hire schedule;
(z) Not allow the Caravan to carry any persons or animals while the Caravan is being towed;
(aa) Not allow smoking in or near the Caravan;
(bb) Not allow any fire or fire smoke in the Caravan;
(cc) Not climb or sit on top of the Caravan;
(dd) Only use breaking mechanisms approved by the vehicle manufacturer or an after-market supplier;
(ee) Comply with all laws relating to the secure and proper towing of Caravans, and ensure indicator and brake lights are working;
(ff) Pay all fines infringements toll incurred while towing or using the Caravan;
(gg) Not carry, tie, or otherwise affix any item on or to the outside of the Caravan;
(hh) Comply with any reasonable instructions of Jayco Bundaberg regarding use of the Caravan;
(ii) Not use the Caravan for or in furtherance of any illegal purpose, or, regardless of lawfulness, in any race, rally, or contest;
(jj) Not use the Caravan to carry passengers or property for hire or reward;
(kk) Must not use the Caravan for purpose of haulage of items, other than as may reasonably required or expected of a hire for leisure;
(ll) Not use abrasive cleaners drops or sponges on any of the finishes of the Caravan;
(mm) Not carry any volatile liquids and gases explosive or other corrosive dangerous combustible all in flammable material in the Caravan or the towing vehicle other than as reasonably required for their operation;
10.2 The Customer must ensure that any other occupier or operator of the Caravan or Towing Vehicle complies with this clause and with the rest of this agreement as it relates to the use, occupation, or operation of the Caravan or Towing Vehicle. 10.3 The Customer consents to Jayco Bundaberg keeping and using tracking equipment on the Caravan and monitoring the location of the Caravan at any time. The Customer must not disengage or otherwise interfere with any such tracking system. The Customer consents to the use and disclosure by Jayco Bundaberg of any data so collected for operational or promotional purposes.
10.4 The Customer’s obligations under this Agreement apply notwithstanding the Hire Period specified, including but not limited to the Customer’s obligations with respect to the use of the Caravan which apply to use of the Caravan before or after the Hire Period in addition to during the Hire Period.
11. DAMAGE, BREAKDOWN, AND REPAIRS
11.1 The Customer must report any damage to the Caravan to Jayco Bundaberg as soon as possible after the damage becomes apparent.
11.2 Except as is reasonably necessary, the Customer must not tow the Caravan following damage to the Caravan, other than merely superficial damage, becomes apparent, or use any damaged part of the Caravan, without the prior approval or consent of Jayco Bundaberg.
11.3 In the event of damage or breakdown, the Customer may contact Jayco Bundaberg outside business hours bv telephone on 0428523559
11.4 The Customer bears the cost, absolutely, for any repair or replacement of the Caravans tyres or rims during the Hire Period, unless:
(a) The Customer can prove beyond a reasonable doubt that the tyre or rim repaired or replaced was defective at the time the Caravan was collected from Jayco Bundaberg; and
(b) The Customer returns the tyre or rim to Jayco Bundaberg for inspection; and
(c) A warranty claim with respect to the tyre is successful.
11.5 The Customer must follow all reasonable directions given by Jayco Bundaberg with respect to any damage of the Caravan, the subsequent use of the Caravan, or the effecting of repairs.
11.6 The Customer must not allow repairs to be carried out with respect to the Caravan or otherwise cause costs to be incurred on behalf of Jayco Bundaberg without first obtaining the written consent of Jayco Bundaberg.
11.7 If the Customer causes the Caravan to be repaired or inspected for the purpose of making repairs or assessing damage, the Customer consents to, and must on Jayco Bundaberg request do everything reasonably possible to facilitate, the reporting of the results of such repair or inspection to Jayco Bundaberg.
11.8 In the event of any motor vehicle accident involving the Caravan, the Customer must:
(a) Notify Jayco Bundaberg immediately, or otherwise as soon as is reasonably possible;
(b) Take all reasonable steps to obtain the names and addresses of any parties or witnesses to the event;
(c) Report the event to police;
(d) Not accept or admit blame or assert the fault of another party;
(e) Record, and if possible photograph, all damage to the Caravan and other vehicles and registration numbers;
(f) Provide to Jayco Bundaberg any photographs, police reports, or other records relating to the event; and
(g) Provide all reasonable assistance to Jayco Bundaberg in relation to any claim, including providing any relevant information or attending court.
11.9 Jayco Bundaberg may, at its absolute discretion, provide the Customer with an appropriate substitute Caravan, in which event the Customer will not be liable for any increased hire charges. Such a substitution does not entitle the Customer to a refund and does not constitute a breach of this Agreement.
11.10 The Customer is liable to Jayco Bundaberg for any costs associated with the retrieval of the Caravan in the event of damage or failure, except where the cause of the failure is proven beyond a reasonable doubt to be wholly due to a mechanical failure of the Caravan (not caused, or in any way contributed to, by the hire to the Customer) or to the fault of Jayco Bundaberg.
11.11 If the Caravan suffers damage or breakdown due to the mechanical failure of the Caravan, the liability of Jayco Bundaberg is limited strictly to a refund of the Hire Charges on a pro rata basis for the remaining part of the Hire Period.
12. RETURN OF CARAVAN
12.1 The Customer must return the cleaned Caravan to Jayco Bundaberg by the Return Time and:
(a) At the place from which the Customer collected the Caravan; or
(b) At such other place that is reasonably nominated by Jayco Bundaberg and communicated to the Customer with reasonable notice.
12.2 The Customer request Jayco Bundaberg to agree to a different Return Time than that originally specified, however this remains in the absolute discretion of Jayco Bundaberg.
12.3 If the Customer returns the Caravan after 5:00pm on a given day, the Customer is deemed to have returned the Caravan first on the next day.
12.4 If the Customer does not return the Caravan in accordance with clause 12.1, the Customer is liable to Jayco Bundaberg for, in addition to any amount otherwise owing under this Agreement: (a) For each day or part thereof after the Return Time in which the Customer has not returned the Caravan in accordance with clause 12.1, a daily hire charge equal to 110% of the pro rata daily Hire Charge as specified for the Hire Period;
(b) An administration fee of $75;
(c) A cleaning fee of $250 or more depending on the cost to clean the Caravan;
(d) Any losses or costs of Jayco Bundaberg relating to its inability to hire the Caravan to any other person;
(e) Any cost of retrieving or attempting to retrieve the Caravan from a location other than that provided for by clause 12.1; and
(f) Any other losses arising from or in relation to the Customer’s failure to return the Caravan in accordance with clause 12.1.
12.5 The Customer must return the Caravan in the same condition as the Caravan was in on the Pickup Date, including as noted in any condition report. The Customer is strictly liable for any damage, state or uncleanliness, or other difference from the condition the Caravan was in on the Pickup Date. 12.6 Without limiting the Customer’s liability under this agreement, if when or after the Customer returns the Caravan it is apparent, to the reasonable satisfaction of Jayco Bundaberg, that the
Caravan or part of the Caravan is not clean, the Customer will be liable to Jayco Bundaberg for a cleaning and administration fee of $250 internal and $250 external. 12.7 Immediately, or otherwise as soon as possible before returning the Caravan to Jayco Bundaberg, the Customer must empty any toiletry systems and ensure any toilet within the Caravan is clean. If the Customer returns the Caravan and has not complied with this clause, or if any toiletry system or toilet is not clean, the Customer will be liable to Jayco Bundaberg for a fee of $500.00 for the replacement of the toilet cartridge and disposal of the used cartridge. The Customer’s liability under this clause is in addition to any other liability with respect to cleaning.
13. TERMINATION AND REPOSSESSION
13.1 Jayco Bundaberg may terminate this Agreement at any time if Jayco Bundaberg is reasonably satisfied that:
(a) The Customer has breached or is likely to breach any part of this Agreement;
(b) The Customer has engaged in fraud or misrepresentation in relation to the hire of the Caravan;
(c) The Caravan appears to have been abandoned;
(d) The Caravan has not been, or is not likely to be, returned by the Return Time;
(e) The safety of any passengers of the Caravan, including the Customer, or the condition of the Caravan is endangered; or
(f) The Customer has, in connection with the Caravan or at all during the Hire Period, broken any law.
13.2 Jayco Bundaberg may terminate this Agreement under clause 13.1 by email or telephone, including by leaving a voice message, to any email address or telephone number, respectively, of the Customer as specified in the Booking Confirmation or Hire Schedule or otherwise advised by the Customer.
13.3 If Jayco Bundaberg terminates this Agreement under or in relation to any of the matters set out in clause 13.1:
(a) The Customer is not entitled to any refund;
(b) Jayco Bundaberg or its agents may, to which the Customer is deemed to consent, enter upon any premises to retrieve the Caravan;
(c) The Customer is liable for any costs associated with the retrieval, towing, and cleaning of the Caravan.
14. INDEMNITY
14.1 The Customer indemnifies and shall keep indemnified Jayco Bundaberg from and against all claims, loss, damages and expenses whatsoever, incurred directly or indirectly by reason of any breach of this Agreement, negligence, malicious or tortious act or other wrong doing by the Customer or a person occupying using or operating the Caravan. Without limiting the foregoing or any of the Customer’s obligations under this agreement, the Customer specifically indemnifies Jayco Bundaberg for:
(a) all damage to or loss of the Caravan howsoever arising to the extent to which the same is not recoverable under any policy or insurance or on account of any act or omission or breach of this agreement by the Customer or any act or omission of a person operating using or occupying the Caravan except to the extent caused or contributed by Jayco Bundaberg.
(b) injury to or death of any person and damage to any property and all claims, damages, losses and expenses howsoever arising from or incidental to the possession, use, operation or towing of the Caravan trailer except to the extent caused or contributed by the owner;
(c) The cost of rectifying all tyre or wheel damage not attributable to fair wear and tear;
(d) Overhead or underbody damage to the Caravan;
(e) Water damage to the Caravan;
(f) Replacing any accessory not attributable to fair wear and tear;
(g) insurance excess payable by Jayco Bundaberg with respect to damage or loss arising with respect to the Customer’s use of the Caravan or an event during the Hire Period.
14.2 Subject to the obligation of Jayco Bundaberg to deliver the Caravan (or, as agreed, a substitute Caravan) under this agreement, the Customer releases Warburton Caravans, including its employees and agents, from any liability to the Customer regardless of fault or any loss or damage incurred by the Customer by reasons of this Agreement, including but not limited to the following:
(a) Any loss or damage caused by breakdown, mechanical defect, accident or the Caravan being unsuitable for a particular purpose;
(b) Any loss or damage to any property left in or on the Caravan or on any Jayco Bundaberg premises or recovered or handled by Jayco Bundaberg. The Customer’s personal property is the personal responsibility of the Customer.ir wear and tear;
(d) Overhead or underbody damage to the Caravan;
(e) Water damage to the Caravan;
(f) Replacing any accessory not attributable to fair wear and tear;
(g) insurance excess payable by Jayco Bundaberg with respect to damage or loss arising with respect to the Customer’s use of the Caravan or an event during the Hire Period.
14.2 Subject to the obligation of Jayco Bundaberg to deliver the Caravan (or, as agreed, a substitute Caravan) under this agreement, the Customer releases Warburton Caravans, including its employees and agents, from any liability to the Customer regardless of fault or any loss or damage incurred by the Customer by reasons of this Agreement, including but not limited to the following:
(a) Any loss or damage caused by breakdown, mechanical defect, accident or the Caravan being unsuitable for a particular purpose;
(b) Any loss or damage to any property left in or on the Caravan or on any Jayco Bundaberg premises or recovered or handled by Jayco Bundaberg. The Customer’s personal property is the personal responsibility of the Customer.
